Terms of Service

These Terms of Service (the "Terms") govern your use of Padelmondo, a platform operated by Upstone LLC (1704 Llano St Ste B-1324, Santa Fe, NM 87505, United States). By creating an account or using the service, you agree to these Terms.

1. The Service

Padelmondo is a SaaS platform that connects padel players with partner clubs worldwide. Padelmondo allows you to: browse partner clubs, book courts, buy credit packs, organize tournaments, track your ELO rating, and rate matches.

2. Eligibility

You must be at least 13 years old. Users under 18 must have parental consent to register and to make payments.

3. Account

• You are responsible for keeping your password confidential.
• You must provide accurate and up-to-date information.
• You agree not to create multiple accounts.
• You agree not to share your account or use someone else's account.

4. Bookings and credits

• Bookings are made using the credit pack system of each club. Each club sets its own pricing.
• Credits are non-refundable but remain valid as long as your account is active.
• Cancellation policy is set by each club (typically 24 hours before the match for free cancellation).
• Padelmondo is a connection platform; the booking contract is concluded directly between you and the club.

5. Payments

Payments are processed by Stripe, Inc. We do not store credit card numbers. Refund disputes are handled in accordance with the policy of the club concerned.

6. ELO and rankings

The ELO rating system is automatic and based on the scores entered and confirmed by players. Padelmondo reserves the right to correct ELO ratings in case of manifest fraud.

7. User behavior

You agree not to:

• Submit false scores intentionally.
• Harass or abuse other players or staff.
• Use the platform for purposes other than its intended use.
• Attempt to circumvent the security of the service.
• Reverse-engineer, scrape, or copy the source code of the platform.

Padelmondo may suspend or delete any account that violates these rules.

7 bis. User-generated content — zero tolerance

Padelmondo lets you create content visible to other users (messages, group chats, profile names, Americano tournaments). There is zero tolerance for objectionable content or abusive behavior. You agree not to post, send, or share any content that is unlawful, hateful, harassing, threatening, defamatory, obscene, pornographic, discriminatory, or that infringes the rights of others.

• Filtering: messages are automatically filtered and objectionable content is rejected before it is sent.
• Reporting: every message and every user can be flagged from inside the app. Reports are reviewed by our team.
• Blocking: you can block any user at any time. Once blocked, their content disappears from your feed instantly and they can no longer contact you.
• Action within 24 hours: we remove reported objectionable content and eject the offending user within 24 hours of a confirmed report.

By creating an account you acknowledge and accept these content rules. Violations lead to immediate removal of the content and termination of the offending account.

8. Intellectual property

Padelmondo, its logo, source code and content are owned by Upstone LLC. You receive a personal, non-exclusive, non-transferable license to use the service.

9. Limitation of liability

The service is provided "as is", without warranty. Upstone LLC's total liability is limited to the amount paid by you in the 12 months preceding the claim. Padelmondo cannot be held liable for: damages occurring on the courts of partner clubs; cancellation of a booking by the club; loss of credits in case of voluntary account deletion.

10. Termination

You may delete your account at any time from your profile. Upstone LLC may close any account that violates these Terms, with or without notice.

11. Modification of these Terms

We may modify these Terms. Material changes will be communicated by email and on this page. Continued use of the service after modification constitutes acceptance of the new Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of the State of Delaware, United States. Any dispute will be submitted to the competent courts of Delaware, except for the rights granted to consumers by the law of their country of residence.
